Fairer Fuel Determination
Today I made a determination that will allow the Fair Work Commission to expedite its consideration of the Transport Workers’ Union and the Australian Road Transport Industrial Organisation’s application to the Fair Work Commission for a road transport contractual chain order to address the impacts of fuel price increases (MS2026/1).
The Australian Government’s recent Fairer Fuel amendments allows me to make a determination to expedite the Fair Work Commission’s consideration of an application for road transport contractual chain standards if I am satisfied that legislative criteria have been met.
In making the determination, I was satisfied that the conflict in the Middle East is having a significant national negative impact on the road transport industry. I was also satisfied that it is in the public interest to make the determination.
To reach this view, I considered the road transport objective in the Fair Work Act and stakeholder views raised during public consultation on the draft determination published on 7 April 2026, as well as evidence and analysis provided by my department.
